Abstract

Since entering office in 2015, the Polish government, under the leadership of the PiS, has subverted the independence of the constitutional court and rendered the division of power ineffective. The ruling party’s interpretation of the law and its legal practice amount to discriminatory legalism. The government is attempting to subject all state institutions, including the courts, to its control. It is employing power mechanisms to promote close associates. Using formal procedures and informal practices, it impedes and harasses critics and opponents, destroys the neutrality of state institutions and undermines the law and the constitutional state.
