Abstract

With its strong ideologisation, Hungary’s new constitution presents an exceptional case among European constitutions. However, criticism that the current government is abandoning the rule of law is not true. The constitution does have some flaws with regard to the rule of law, but overall it remains within the framework of what is acceptable in the European Union. Nonetheless, it provides some starting points for a illiberal majority to curtail the rule of law.
